If you do not wish to be bound by this agreement, you should immediately return the CD's, unused, with your proof of purchase, to the place where you purchased it. MetaTools, Inc. grants a non-exclusive license to use the images in this package according to the following terms:
All the images are royalty-free for your personal or professional use. The images can be used on presentations, package designs, advertisements, brochures, collateral material, newsletters, and similar publications, provided the purpose of the product you create is not to redistribute the image or images provided in Power Photos.
You may not use any Power Photos images in a way not specifically allowed by this agreement, without the prior written permission from MetaTools to do so. To obtain written permission, please forward your request to MetaTools, Inc., 6303 Carpinteria Avenue, Carpinteria, California 93013, Attention Legal Department. These images are protected by United States Copyright laws and unauthorized or improper use of any Power Photos image is a violation of Federal Law. The images contained herein are the property of PhotoSpin, Inc. and are used with permission by MetaTools.
While the images may be used as backgrounds in presentations on any medium, they may not be redistributed in their original form or a form created solely to facilitate redistribution of the images. For example only, and in no way limiting the foregoing, you may not place any of the images on this CD on an electronic bulletin board or other form of on-line service.
None of the images on this CD may be used in any form of pornography, or in any other manner which is in any way embarrassing to or defamatory of any person or business entity, or which implies any form of endorsement by MetaTools, Inc. or PhotoSpin, Inc.
You agree to indemnify, defend and hold harmless MetaTools, Inc. and PhotoSpin, Inc. against any damages or liability of any kind arising from any use of this product.
Neither MetaTools, Inc., nor any of its directors, officers, employees, partners or agents shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or the inability to use, this or any Power Photos CD-ROM.
